Per the discussion in the comments, this will be dealt with in the text of the IG. The IG will provide guidance on what implementers should / could do when the patient identity is not (yet) known by the device....while keeping Observation.subject mandatory for compatibility with the FHIR Core profile "Vital Signs." (paraphrasing Javier's comment)

Also, dividing the profile into two parts, one where the patient association is known and another where the patient association is unknown and compliance to the Vital Signs Profile is not possible and the patient information.

The specification mandates the inclusion of a subject.

I think this is to strict. Due to privacy concerns or device design, the subject (patient) may not be known by the device.

Please relax this requirement (back to) optional --> cardinality 0..1
