Discrepancy in US Core smoking status 'issued' use versus other Observation profiles where the Observation is retrieved by date

In the smoking-status profile, https://www.hl7.org/fhir/us/core/StructureDefinition-us-core-smokingstatus.html <-- need some guidance... I think this profile has a mistake
it uses 'issued' but issued isn't a searchable field in the Observation resource.
 
Two questions...
shouldn't it use effective?
or
provide a SearchParameter for the corresponding Observation.issued field?
